Oyster Farmer Battles Federal Government's Order to Shut Down

Lunny has an ally in Sen. Dianne Feinstein, D-Calif., who had tried to get the lease extended for another decade. But even her clout failed to sway U.S. Interior Secretary Ken Salazar.
“I am extremely disappointed that Secretary Salazar chose not to renew the operating permit for the Drakes Bay Oyster Company,” Feinstein said in a statement. “The National Park Service’s review process has been flawed from the beginning with false and misleading science, which was also used in the Environmental Impact Statement. The secretary’s decision effectively puts this historic California oyster farm out of business. As a result, the farm will be forced to cease operations and 30 Californians will lose their jobs.”

 But in a little-noticed memorandum from Salazar, the Secretary of the Interior made it clear that his decision was not based on the oyster farm's impacts on Drakes Estero in Point Reyes. Instead, Salazar stated flatly that his decision to not renew Drakes Bay Oyster Company's lease was "based on the incompatibility of commercial activities in wilderness ...."

In his first year back as governor, Brown signed one bill fast-tracking legal review under CEQA for a proposed football stadium in downtown Los Angeles and another speeding up big projects (costing at least $100 million) that incorporate high environmental standards. But he pulled back on a push to exclude high speed rail construction from CEQA. There has also been talk of excluding proposed water-transporting tunnels under the Sacramento-San Joaquin river delta.
