Former Fed Judge Oliver Wanger Earns Trial Victory
Hmmm...coupled with Judge Wanger's first public speaking event immediately after his retirement from the bench was at the Southern California Water Committee's 4th Quarter dinner in which his parting shot off the stage was (paraphrasing)...blah, blah, blah and guess what folks? I was born and raised in Beverly Hills....looks like some chumminess paying off as stated in the article. Amazing?  What was amazing was how easily Resnick got out of testifying to anything under oath.
The trial in Black's courtroom was supposed to dig deeper into the water-for-pistachios allegation against Paramount. A key witness was going to be billionaire Stewart Resnick, who owns Paramount. Because of Wanger's trial-ending move, Resnick no longer has to testify.
"It's pretty amazing," Wanger said of the trial's quick ending.

Background

Counties (This also included all public entities, Councils, Commissions, Advisory Boards, etc.) use "consent agendas" to lump a lot of separate actions into a single up-down vote, similar to how omnibus bills are used by legislators. Unless someone objects to an item, it can be passed without discussion and without separate vote. County approval of endangered species listings have been approved in this manner.  If someone does object, however, the challenged item must be separately considered, discussed, and voted on. By law, consent agendas must meet the same public notice requirements as normal agenda items.

Terry's Recommendations
o Have someone in your group monitor consent agendas and alert your group of items that should not be passed without challenge.
o Formally object to items that are objectionable to force open discussion and make county commissioners accountable/liable for their actions.
o Object to all ESA listings. During discussion, demand proof the science and EIS/EIR behind the proposal are factual, and that the proposed action has a quantitative and measurable objective as to the numerical threshold that justifies delisting.

Lunny has an ally in Sen. Dianne Feinstein, D-Calif., who had tried to get the lease extended for another decade. But even her clout failed to sway U.S. Interior Secretary Ken Salazar.
“I am extremely disappointed that Secretary Salazar chose not to renew the operating permit for the Drakes Bay Oyster Company,” Feinstein said in a statement. “The National Park Service’s review process has been flawed from the beginning with false and misleading science, which was also used in the Environmental Impact Statement. The secretary’s decision effectively puts this historic California oyster farm out of business. As a result, the farm will be forced to cease operations and 30 Californians will lose their jobs.”

This is not about 'privatizing' Drakes Estero, this is about the U.S. Government honoring its word (Native Americans can snort/laugh at that one) of renewing leases in 40 year intervals in perpetuity.  I find the missing word 'perpetuity' somewhat disturbing.  Without that critical word inserted into the dialogue, then it does appear the U.S. Gov't can opt not to renew the leases.  Don't forget this is a 'working landscape' in this NPS controlled area...I also say "heads up potential 'willing sellers' in the Delta, this can happen to you'.

Working Landscapes, NPS, Perpetuity, Sound Familiar?  What is happening over at Drakes Bay, can and will happen eventually in the Delta.  Did the DPC just address 'working Delta landscapes' at their last meeting.  Well, take a good hard look at a 'working landscape' that came under control of the NPS (National Heritage Area, anyone?).  

The Federal Government has reneged on its contract with these private property owners to renew 40 year leases into perpetuity, which was why the EASEMENTS/SALES went through...and now look at where they are.
