Oyster Farmer Battles Federal Government's Order to Shut Down

(Keep this in mind for future reference in similar situations in the Delta:
Lunny has an ally in Sen. Dianne Feinstein, D-Calif., who had tried to get the lease extended for another decade. But even her clout failed to sway U.S. Interior Secretary Ken Salazar.
“I am extremely disappointed that Secretary Salazar chose not to renew the operating permit for the Drakes Bay Oyster Company,” Feinstein said in a statement. “The National Park Service’s review process has been flawed from the beginning with false and misleading science, which was also used in the Environmental Impact Statement. The secretary’s decision effectively puts this historic California oyster farm out of business. As a result, the farm will be forced to cease operations and 30 Californians will lose their jobs.”

California Oyster Farm Sues U.S. Government to Keep Business
This is not about 'privatizing' Drakes Estero, this is about the U.S. Government honoring its word (Native Americans can snort/laugh at that one) of renewing leases in 40 year intervals in perpetuity.  I find the missing word 'perpetuity' somewhat disturbing.  Without that critical word inserted into the dialogue, then it does appear the U.S. Gov't can opt not to renew the leases.  Don't forget this is a 'working landscape' in this NPS controlled area...I also say "heads up potential 'willing sellers' in the Delta, this can happen to you'.

Working Landscapes, NPS, Perpetuity, Sound Familiar?  What is happening over at Drakes Bay, can and will happen eventually in the Delta.  Did the DPC just address 'working Delta landscapes' at their last meeting.  Well, take a good hard look at a 'working landscape' that came under control of the NPS (National Heritage Area, anyone?).  

The Federal Government has reneged on its contract with these private property owners to renew 40 year leases into perpetuity, which was why the EASEMENTS/SALES went through...and now look at where they are.

(My opinion, California Farm Bureau should be supporting ALL farmers and stop quasi pitting one group of farmers against another, period.  How can the Bureau file suits to protect farmland against High Speed Rail in the Central Valley, yet do absolutely nothing as a state-wide organization to support farmers and farmland in the Delta against the ill-fated Peripheral Anything??

Both supposed projects are nothing more than wealth redistribution, land theft and water heisting in its finest form.  The deliberate breaking up of long-held, original California founding families holdings is deliberate, willful and being perpetuated upon all of us under the guise of 'water supply reliability' and 'ecosystem restoration' and will come down via inverse condemnation, declarations of 'critical habitat', 'buffer zones', anything NPS wants to put out as 'science' (potential NHA designation ala Drakes Bay, folks.) 

The California Farm Bureau should make a united stand against ANY theft of ANY of California's Prime Soil rated agriculture lands.  After all, that's what they organized for in the first place, to protect, defend, advocate and lobby for ALL farmers in their organization, correct???

There is one better alternative to the Delta boondoggle that would actually resolve most of the ecosystem, and supply reliability issues, do the least amount of harm to the geographic areas involved, ecosystem and private property while providing the highest return on investment of all resources dedicated to such resolutions.  It is the Western Delta Intake Concept put forth by Dr. Robert Pyke. 

Neither these two con jobs are nothing more than hijacking of our public processes and resources for personal gain by a very, very, very small circle of people, to the complete and utter devastation of California and her citizens from Oregon to Mexico borders.)

(This is more like it...finally, someone addressing the fact that So Cal's concrete ditch is their biggest threat or liability to their 'water supply reliability'...not the levees in the Delta.

Not to mention this concrete ditch has subsided in some areas up to four feet.  That's a 4 foot sink hole or drop off in that ditch.  I'd be more concerned about that coupled with the fact it runs parallel to the San Andreas fault, but hey, what do I know???)
